Judge OKs pain tactics against anti-abortion demonstrators (7/94)

The U.S. Ninth Circuit Court of Appeals in San Francisco has ruled
2-1 that San Diego police did not use excessive force when they used
Oriental martial-arts weapons on anti-abortion protesters.
Police used "nunchucks" -- or nunchakus, double billy clubs
connected by a chain or leather thong -- on protesters demonstrating
outside women's health clinics in 1989. The court ruled that police
may inflict pain to break up nonviolent demonstrations.
In a dissent, Circuit Judge Andrew J. Kleinfeld said the use of
nunchakus against nonviolent demonstrators was "ineffective and
brutal" and violated the Constitution. Kleinfeld also said it was possible
that the policy violated the First Amendment, since it only was
directed at anti-abortion demonstrators.
